1. Introduction

Welcome to Echoes (the “App”), operated by Noble Dugong Ltd (“we,” “our,” or “us”), a company incorporated in England and Wales. Echoes is a location-based audio sharing platform that allows users to create and discover audio recordings (“Echoes”) tied to specific geographic locations. By accessing or using the App, you agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, you must not use the App.

We reserve the right to refuse access to the App to anyone, for any reason, at any time.

2. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are 18 years of age or older and have full legal capacity to enter into binding agreements. Use of the App by anyone under 18 is strictly prohibited and constitutes a violation of these Terms.

3. User Accounts

To access certain features, you may be required to register for an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

Users may use aliases or display names, but must not impersonate another individual, organization, or misrepresent their identity or affiliation in any way.

We reserve the right to reclaim usernames that are inactive, violate third-party rights, impersonate others, or are otherwise deemed inappropriate or misleading. We may suspend or terminate accounts at our sole discretion, with or without notice, for any reason.

4. User Content

4.1 Ownership and License

You retain ownership of any audio recordings or other content you submit through the App (“User Content”). However, by submitting User Content, you grant Noble Dugong Ltd a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and display such content in connection with the App and our business, including for promotional and commercial purposes. This license survives termination of your account.

4.2 Content Restrictions

You agree not to upload, post, or transmit any content that:

• Is unlawful, harmful, abusive, defamatory, obscene, or invasive of privacy
• Infringes on intellectual property, publicity, or other proprietary rights
• Contains malware, viruses, or any code that could harm the App or its users
• Falsely represents your identity or affiliation
• Violates any applicable law or regulation
